Flexibility in Form I-9 Requirements

The deferment applies to employers and workplaces that are operating completely remotely, and are in effect until May 19, or within three business days after the termination of the national emergency, whichever comes first.

Employers who virtually verify I-9 documents will need to specify that they have delayed physical inspection due to COVID-19 in the Additional Information box in Section 2.

Please note that you will be expected to physically examine documents once the COVID-19 extension has terminated. You'll also need to update the Additional Information section with a note that that you have physically verified documentation and the date.
