Employment Practices Liability (EPL) insurance

Employment Practices Liability, or EPL, protects a company against wrongful termination, sexual harassment, or discrimination claims from the insured’s employees, job applicants, and former employees.

EPL covers directors and officers, management personnel, and employees as insureds. In addition, the policy typically covers claims from a variety of other types of inappropriate workplace conduct, including but not limited to employment-related:

  • defamation
  • invasion of privacy
  • failure to promote
  • deprivation of a career opportunity
  • negligent evaluation.

EPL is typically on the same policy as D&O, referred to as Management Liability Policy. The exposure to an EPL claim exists as soon as a company starts hiring employees. Companies typically purchase this coverage when they grow to about 20 employees and have enough funds.
